The terms listed below shall be deemed as a contract between you (the Customer) and ‘Amie Herriott’. In cases where ‘Amie Herriott’s’ Customer is acting as an intermediary, all references in this agreement to the Customer shall be interpreted as references to ‘Amie Herriott’s’ Customer and their Customer(s).
In commissioning ‘Amie Herriott’ to undertake an assignment the Customer is deemed to have read and agree to the below terms of business.
Booking Fee
A booking fee of £400 is required to secure your wedding photography date. Dates are reserved only when the booking fee is paid. This sum will apply towards the contracted fee and is non refundable.
Payments
The outstanding fee is payable in full 1 month before the wedding. According to Travel Experta payment for additional services on the photographs is made when these are ordered, i.e. digital enhancements or reprints. Any bank charges incurred due to returned cheques will be debited to the client. Additional costs may be charged on reprint orders placed 12 months after the job. Return journeys in excess of 50 miles may attract a mileage charge of 40p per mile. Overnight accommodation may be required for weddings over 100 miles away from Central London.
Meals, Accommodation and Travel Costs
The client is required to arrange a meal where coverage extends over the meal. For weddings over 100 miles from Central London, the photographer reserves the right to charge for overnight accommodation and travel costs. This is to ensure that your photographer is in the best condition for your day.
Weather and Delays
Weather permitting the photographs will be taken as agreed. In the event of inclement weather the photographer, in cooperation with the client will make necessary changes to the schedule and will do her best to produce coverage of the job within the time allocated to her. Similarly, when delays occur due to circumstances out with her control, the photographer will stay on beyond the agreed time if required, for an additional fee.
Requested Photographs
The photographer will honor requests for specific photographs subject to the following: weather and time permitting, availability and the cooperation of the persons involved. All such requested photographs must form part of the clients’ final order. ‘Amie Herriott’ cannot be held responsible for the lack of coverage caused by the subject. The photographer does not guarantee any specific picture nor to include any specific background, location prop or arrangement although every effort will be made to interpret the client’s wishes.
Image Reproduction
a) Owing to photochromatic anomalies caused by a combination of certain dyes and materials, especially in man-made fibres, it is sometimes impossible to record on camera the exact colour of materials as perceived by the human eye. When processing images, the photographers will endeavour to achieve a pleasing overall colour balance based on natural flesh tones.
b) It is understood that some colours may not remain consistent throughout a set of photographs owing to variations in lighting conditions. It is also understood that all photographic printing is undertaken within the technical limitations of the process and that colour may not be identical over the whole range within a subject. The colour balance of prints made at different times or in varying sizes may also be variable.
c) Due to the limitations of computer monitors it is understood that images may appear differently according to the specification of each monitor and that prints will not match images rendered on any particular computer monitor.
Ownership
All rights to the image(s) are owned by ‘Amie Herriott’ and are protected by International copyright laws and other applicable laws. ‘Amie Herriott’ reserves the right to use the photographs for display, promotional and all other purposes unless otherwise agreed with the client.The clients shall have no right to reproduce, nor to authorize the reproduction of any means whatsoever, any photographs created by ‘Amie Herriott’.
Cancellation
In the highly unlikely event of cancellation by photographer, or unavoidable total photographic failure, the photographers’ liability shall be limited to a full refund of any booking fees and fees paid. Re-shoots may be arranged if practicable but the photographers will not be responsible for any further costs.
The photographer will endeavor to appoint another photographer in the unlikely event that he is unable to attend a booking. However it may prove difficult or impossible to find a skilled replacement photographer at short notice or at the same price.
If the Clients should have to cancel they are entitled to a full refund of the £400 booking fee if they withdraw within 14 days of booking. The booking fee of £400 will be forfeited on cancellations made after 14 days. Cancellations made within one month of the wedding incur the full cost of the basic photographic service booked.
Supply
Images are sold “as is” and user is responsible for their use unless otherwise agreed. All photos should be suitable for printing upto A4 in size, any larger may result in poor image quality. Where images are requested to be modified or re-sized the workmanship is warranted to be in accordance with your written requirements. Digital image(s) are virus scanned before delivery and are free of known viruses at the time of delivery.
User Warranties
You warrant that you will take all necessary steps to prohibit and prevent duplication or further distribution of the image(s).
Damages
You agree that you are fully responsible for the use of and any consequential effects arising from the use of any photographic image and fully indemnify ‘Amie Herriott’ against inclusion in any proceedings or damages arising directly or indirectly from the use of any purchased photographic images.
Termination
This agreement shall terminate immediately if any of its provisions are violated. Upon termination you must immediately stop using the image(s) and delete all copies from your website(s).
Acceptance
Your purchase and use of any photographic images or services constitutes your agreement and acceptance of these terms and conditions.
